Terms of Use
Last updated: 11 September 2026
Welcome to Haaptick. These Terms of Use govern access to haaptick.com and its related website content, operated by Haaptick, a trading name of Spark Quest Pty Ltd (ABN 19 677 592 451) (“we”, “us” or “our”). By using the website you agree to these terms. If you do not agree, please discontinue use. Machine supply, pilots, installations and campaign services are subject to a separate written agreement.
1. Acceptance of Terms
These terms apply to visitors using the Haaptick website, its demonstrations and related resources. They do not replace a signed proposal or service agreement, or the separate terms and privacy notices for a retailer’s activation.
2. Eligibility
You must be at least 18 years old and authorised to represent your organisation to enter a business agreement with us. Eligibility to participate in a retailer’s activation is set out in that campaign’s rules. You agree to use this website in compliance with applicable laws.
3. Changes to the Terms
We may update these website terms by posting a revised version with an updated date. Changes apply to future use of the website and do not retrospectively change a separate service agreement.
4. Use of Website and Services
Haaptick grants you a limited, non-exclusive, non-transferable licence to access and use this website for personal or internal business purposes. You must not engage in unlawful or fraudulent activity, interfere with the website’s operation or security, transmit harmful code, or attempt to access non-public areas. The client-login page is a placeholder and does not provide account access.
5. Intellectual Property
Ownership: All content, branding, and materials on this website—unless otherwise noted—are owned by Haaptick, a trading name of Spark Quest Pty Ltd (ABN 19 677 592 451) or its licensors and are protected by intellectual property laws. Restrictions: You may not copy, modify, distribute, or create derivative works of any content without explicit written permission from Haaptick. Trademarks: Haaptick’s name, logos, and any service marks may not be used without our prior written consent.
6. Disclaimers
Website content provides general information about the Haaptick offering. Machine images, the fictional retail brand, phone flows and dashboard figures are illustrative concepts, not customer results or a promise of a particular configuration. Availability, dimensions, finishes, integrations, servicing, pricing and campaign scope are confirmed in a written agreement. We do not guarantee a particular number of sign-ups, sales or return on investment. Links to third-party resources do not imply endorsement or responsibility for their content.
7. Limitation of Liability
Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable guarantees under the Australian Consumer Law. Subject to those rights, to the maximum extent permitted by law, Spark Quest Pty Ltd trading as Haaptick, its employees and agents are not liable for indirect or consequential loss arising from use of, or inability to use, this website, including loss of profits or data. Liability relating to separately agreed services is addressed in the relevant agreement, subject to applicable law.
8. Indemnification
To the extent permitted by law, you are responsible for reasonable losses and costs arising from third-party claims caused by your unlawful use of this website or infringement of third-party rights. This does not apply to losses caused or contributed to by our negligence or breach of these terms, and does not limit rights that cannot lawfully be excluded.
9. Termination
We may restrict or suspend website access where reasonably necessary to address misuse, a security risk or a breach of these terms. We will give notice where reasonably practicable. Suspension or termination of separately agreed services is governed by the relevant agreement and applicable law.
10. Governing Law and Jurisdiction
These website terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them, subject to any rights or jurisdiction that cannot lawfully be excluded.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall otherwise remain in full force and effect.
12. Entire Agreement
These terms govern use of this website. Our Privacy Policy explains how we handle personal information. A separately agreed proposal, supply contract or service agreement governs the relevant engagement and prevails to the extent of any inconsistency about that engagement.
